This text constitutes the general terms and conditions of sale of our tour agency (hereinafter referred to as “REGENT TOURS”) and of our website accessible at “https://noumeaturtletours.com/”. By accessing or using this Website, you are deemed to accept these terms and conditions and we reserve the right to refuse access to all or part of the Website to any user who does not comply with them. We inform you that the Site is subject to French law, to French jurisdiction and that its official language is French.

REGENT TOURS: Individual company specialising in the organisation and sale of excursions and tourist, nautical and minibus tours on the island of Pines-Nouméa.
CUSTOMER: Natural or legal person requesting a quote or a reservation on the website, by email or by phone.
SERVICE: All products developed, offered and sold by REGENT TOURS or one of its partners or service providers. This may include excursions, services, transport, etc.

1 – INFORMATION AND QUOTATION
The client can contact REGENT TOURS by any means at his disposal (email, telephone, messaging service…). A quote can be issued free of charge on request or automatically on the website. This quotation is non-binding and is only valid until the start date of the holiday. The client may validate this quote at any time by accessing it using the identifiers that he/she will have received by e-mail. They may also request as many quotes as they wish and validate the one they choose.

2 – BOOKING
To book one or more excursions, the Customer must validate the quote that he/she has made and chosen beforehand. To make a reservation, the Client must choose one of the means of payment proposed on the Website and pay a deposit at least 72 hours (SIXTY TWO) before the date of the beginning of their stay. This reservation is firm, definitive but subject to compulsory confirmation by NOUMEA TURTLE TOURS.

3 – PAYMENT
In order to proceed with the booking, the client must validate the quotation offered to him/her by making the necessary deposit payment in Australian dollars (AUD). Several methods are available to the client:
– Secure online payment by credit card
– Payment via a EpayNC en franc xpf (franc pacifique)
– By bank transfer, or cash on site on the day of the tour
The client must then pay the remaining balance on the day of each excursion, in cash and in Pacific Francs (cfp) to the driver or tour leader, unless otherwise stated. This amount is indicated on each booking ticket, together with its equivalent in Australian dollars (AUD).
It is possible to pay the total amount in one go. REGENT TOURS advises the Client to always have some pocket money to pay for small unforeseen expenses, increases due to a different exchange rate between AUD and Pacific Franc.

4 – MODIFICATION
REGENT TOURS reserves the right to modify at any time the content of the services offered if circumstances so require. The programmes and timetables mentioned on the website are given as an indication and are not contractual. Date, time, mode of transport, route, visit time, catering service… each aspect of a service may be modified without delay and without any claim being made. However, for the sake of transparency, REGENT TOURS will endeavour to inform the client as soon as possible, to justify its modifications and to update its website so that the description of the services is as close as possible to reality. Of course, the client understands that unforeseen circumstances (strike, weather, transport, etc.) may compromise the smooth running of a service and therefore its modification or even cancellation.

5 – CANCELLATION and REFUND
5.1 – REGENT TOURS reserves the right to cancel a service or a reservation and undertakes to inform the client as soon as possible and to propose, depending on availability and the dates of the stay: A) a new date. B) an equivalent service from another partner. C) a refund of the sums paid for the cancelled service(s). This cancellation may be due to a problem of availability, weather, transport, force majeure or any other reason that REGENT TOURS could not have foreseen at the time of booking. If the client accepts the new conditions, a new booking form will be issued and will be quickly available on the client’s account on the REGENT TOURS website. Finally, the client may also request a refund equivalent to the amount paid. This refund will be made within 15 (FIFTEEN) days of the request, by the means of their choice.
5.2 – The client may cancel the service(s) booked by contacting us directly by the means at his disposal. The client may not claim any refund. The same applies if the customer does not show up for the service(s) booked. The client can always ask REGENT TOURS to change the date of the tour one day before departure. REGENT TOURS may proceed with the change of departure date if the new date has not yet been booked by another client. If no new date is available, the client will lose the amount already paid for the reservation, or the total amount of the tour price. Except in cases of force majeure and upon presentation of proof.

REFUND:

Cancellation more than 60 days from the departure date: 50% refunded
Cancellation more than 45 days from the departure date: 40% refunded
Cancellation more than 30 days from the departure date: 30% refunded
Cancellation more than 15 days from the departure date: 15% refunded
Cancellation more than 7 days from the departure date: 10% refunded
Cancellation less than 7 days from the departure date: no refund will be given

6 – TRAVEL INSURANCE
By taking part in one of our excursions, the client and his/her companions declare that they have taken out travel insurance. This insurance must cover any damage caused to the client himself, to others or to property, emergency medical care and repatriation, accidents, etc. Some bank cards already include this insurance free of charge (check with the bank). If the customer does not have insurance, he/she can take out insurance with his/her travel agent or directly on the internet via Mondial Assistance for example.

7 – LIABILITY
All agreements concerning transfers, catering, transport and visits carried out as part of the excursions have been made by REGENT TOURS as transport agent, on the express condition that all damage, injury, loss, accidents or irregularities caused by any natural or legal person employed during the operation are not under its responsibility. Indeed, REGENT TOURS declines all responsibility in all such cases.
REGENT TOURS undertakes to make every effort to provide up-to-date and accurate information on its Internet Site. However, REGENT TOURS cannot be held responsible for any errors, omissions or results that may be obtained by misusing this information. REGENT TOURS reserves the right to correct these errors as soon as they are brought to its attention and, more generally, to modify, at any time, without prior notice, all or part of the Website as well as the general conditions described on this page, without being held responsible for this. Downloading of any material when using the service will be at the customer’s own risk. The customer is solely responsible for any damage to their computer or loss of data resulting from such downloading. More generally, REGENT TOURS cannot be held responsible for any direct and/or indirect damage resulting from the use of this website.
The photos and descriptions published on the Website are not contractual.

8 – INTELLECTUAL PROPERTY & DATA PROTECTION
The Site and each of its components (its tree structure, trademarks, graphics, texts, photographs, etc.) are subject to French and international legislation, in particular that relating to copyright, databases and intellectual property. All other trademarks mentioned are the property of their respective owners. Any unauthorised reproduction, representation, publication, transmission or, more generally, any unauthorised use of the Site and/or its elements engages your responsibility and is likely to result in legal proceedings, in particular for counterfeiting, as sanctioned by articles L.335-2 et seq. of the French Intellectual Property Code. Any link to this Site must be subject to prior authorisation.
In accordance with Article 27 of the French Data Protection Act of 6 January 1978, you have the right to access, modify, rectify and delete data concerning you. This data is collected via the forms on the Website, by telephone or in agency for purely administrative and non-commercial purposes.
By accepting the present general conditions, the client agrees that his/her image may be used on the Website for non-commercial purposes. Indeed, REGENT TOURS reserves the right to publish photographs or videos showing the client in a situation during a service. However, if the client is opposed to their image being used and does not wish to appear on the Website, they can make a written request at any time. On the other hand, REGENT TOURS will always ask for the client’s permission if their image is to be used for commercial purposes (brochure, poster, website, etc.).
